# Tucker Carlson 2026 FARA referral

The **Tucker Carlson 2026 FARA referral** is the criminal referral to the U.S. Department of Justice against [Tucker Carlson](https://www.kiripedia.org/wiki/tucker-carlson), circulated in March 2026, that alleged treason, espionage and Foreign Agents Registration Act violations on the claim that Carlson was a paid agent of the Iranian government.[1] What Carlson had actually done, in [John Kiriakou](https://www.kiripedia.org/wiki/john-kiriakou)'s account, was try to arrange an interview with Iranian leaders.[2] Kiriakou, a personal friend of Carlson's, treated the episode as an [AIPAC](https://www.kiripedia.org/wiki/aipac)-adjacent escalation and spent the following week publicly dismantling it.[3][4]

## Not a CIA crimes report

The initial and near-universal assumption, which Carlson himself shared, was that the [CIA](https://www.kiripedia.org/wiki/cia) had filed the report.[1][2] Kiriakou said flatly that *"that's not how the system works,"* and explained the mechanism from the inside.[5] Almost every morning at the agency, one of the deputy director's briefers would report a leak in the *New York Times*, the *Washington Post* or the *Wall Street Journal*, and the deputy director would say *"okay, send over a crimes report."* A crimes report is simply a memo from the CIA to the Justice Department recording what the leak said and why the material is classified. *"Ninety-nine times out of a hundred they just file it. One time out of a hundred, maybe they'll start doing an investigation."*[6] Against that background the attribution *"didn't really make sense"* to him.[1]

On the Sunday, the political activist [Laura Loomer](https://www.kiripedia.org/wiki/laura-loomer) claimed authorship: *"It was me. I did it. I did it. I wrote a letter to the Justice Department and I said that Tucker Carlson is a paid agent of the Iranian government and he should be arrested for treason."*[7] Kiriakou characterises the admission as one of being *"an instrument of Israel."*[3]

## Treason, FARA, and the difference between them

Kiriakou's public rebuttal turned on the gap between the word Loomer used and the offence she described. Treason *"is constitutionally defined. People throw around that word like it has no real meaning. It has very specific meaning. And in almost every case it carries with it the death penalty."*[8] Carlson has no access to classified information, so even if the underlying allegation were true it would amount only to a Foreign Agents Registration Act violation — *"which means failing to fill out an internet form."* Kiriakou, who wrote an op-ed on the point, looked up the sentencing guideline for a first offence: zero to six months in the local jail. *"Zero to six months is not exactly the death penalty, is it?"*[9][10]

He rejected the premise as well as the charge. Carlson makes eight figures a year, and his step-grandfather was the Swanson of Swanson frozen foods — *"the TV dinner was created by Tucker Carlson's family. They're rich beyond their wildest dreams. He doesn't need Iranian money."*[11]

## Kiriakou's assessment of Loomer

Kiriakou's characterisation of Loomer is unusually blunt for him and he made a point of saying so on the record: *"She's a nut. And I'm happy to say that publicly."* He noted that she is banned for life from Uber, Lyft and Target over anti-Arab and anti-Muslim hate speech and her insistence *"that people become violent against Muslims and Arabs"* — *"there are not very many people in public life as hateful and angry and bigoted as Laura Loomer."*[12][7][4] He read the referral as an attempt to stay relevant: she ran for Congress around 2018 in the district containing Mar-a-Lago and Palm Beach and took about 23 per cent, is not *"smart enough to have her own show on Fox or Newsmax or anywhere else,"* and so *"throws a grenade into the middle of the room every once in a while just to see what happens."*[10][13]

The motive he assigns is not personal but institutional: *"Laura is doing AIPAC's dirty work here by trying to silence Tucker Carlson. She doesn't know Tucker Carlson at all. This isn't going to silence him. It's going to embolden him."*[4]

## Legal versus physical exposure

Carlson told Kiriakou he saw no serious legal jeopardy — he was *"blessed with plenty of money"* and had *"great lawyers"* — and that the referral was *"meant to silence me, and it's not going to silence me."*[14] Kiriakou agrees on the legal analysis but says the thing he actually worries about is Carlson's physical safety: *"there are a lot of crazy people out there,"* and someone lying in wait, in the pattern of what happened to [Charlie Kirk](https://www.kiripedia.org/wiki/charlie-kirk-shooting), is a risk he takes seriously. ## Kiriakou's public response, and the cost of it

Kiriakou announced on air that he would write and tweet in support of Carlson the same day, framing it as a moment for an ideologically mixed coalition: *"I will not answer to AIPAC. Tucker will not. [Candace Owens](https://www.kiripedia.org/wiki/candace-owens) will not. And there are others."* The task, as he put it, was to encourage people on both the left and the right to stand up against AIPAC and against Israeli power in American politics *"and to stand in support of human rights, whether Palestinian or Iranian or anybody else's."*[17][18]

Loomer then turned on him. Over one weekend he was attacked on X and called a communist; he declined to reply — *"I'm actually decidedly a capitalist"* — on the ground that *"she's not important enough to respond to."*[19][20] In a later account he describes waking one Sunday to half a dozen emails from friends saying she was *"just tearing you up on Twitter,"* having called him *"a Russian spy, a Russian asset, and a common criminal."* He consulted the lawyer who had previously forced a retraction out of another online accuser, and was advised to let it go: *"nobody takes Laura Loomer seriously."* The next day, he says, she had moved on to someone else.[21][22][23]

## What Kiriakou reads the referral as being for
