John Kiriakou's July 2025 report, sourced to Matt Taibbe, that the Justice Department was moving beyond referred misdemeanour charges against John Brennan and James Comey for allegedly lying to Congress and was actively pursuing felony conspiracy charges against at least Brennan — a prospect Kiriakou said he would attend the trial of every single day.
The discussion began with Donald Trump’s suggestion that Barack Obama could be arrested over the Russia election affair. Kiriakou dismissed it on Trump’s own precedent: “thanks to Donald Trump going to the Supreme Court, a president can’t be arrested for anything.” All Obama would have to argue “is that he did it in the exercise of his functions as president of the United States.”[1]
Brennan is not
“Now, John Brennan is another issue,” he said. What the Justice Department had been referred were misdemeanour charges against Brennan and Comey “related to allegedly lying to Congress.”[2]
Kiriakou had, immediately before going on air, interviewed Matt Taibbe for his other podcast, Deep Focus. Taibbe confirmed the misdemeanour referral and added to it: what he was hearing was that prosecutors “are actively pursuing felony conspiracy charges against at least Brennan and maybe Brennan and Comey.”[2][3]
What he would do about it
Kiriakou did not affect neutrality about the prospect. He had mentioned it to the host offline already: “I will go to Brennan’s trial every single day. I mean it.” Told he would be there with a grin on his face, he answered: “Karma is real.”[3]
